FxifyApp – Terms and Conditions

Welcome to FxifyApp ("Fxify", "we", "our", or "us"). These Terms and Conditions ("Terms") govern your access to and use of the Fxify website, mobile applications, and related services (collectively, the "Platform"). By accessing or using FxifyApp, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About FxifyApp

FxifyApp is a technology platform that connects users ("Clients") with independent service providers ("Professionals" or "Service Providers") for on-demand services such as handyman work, repairs, moving assistance, and other related services. Fxify does not provide these services directly and is not an employer, agent, or contractor of any Service Provider.

2. Eligibility

To use FxifyApp, you must:

  • Be at least 18 years old;

  • Have the legal capacity to enter into a binding contract;

  • Provide accurate and complete registration information.

We reserve the right to suspend or terminate accounts that do not meet these requirements.

3. Account Registration

You may need to create an account to use certain features of the Platform. You are responsible for:

  • Maintaining the confidentiality of your login credentials;

  • All activities that occur under your account;

  • Notifying us immediately of any unauthorized use.

Fxify reserves the right to refuse registration or cancel accounts at its discretion.

4. Role of Fxify

FxifyApp:

  • Acts solely as a marketplace and intermediary;

  • Does not supervise, direct, or control Service Providers;

  • Does not guarantee the quality, safety, legality, or suitability of services;

  • Is not responsible for disputes between Clients and Service Providers.

All service agreements are entered into directly between Clients and Service Providers.

5. Services and Bookings

  • Clients may request services through the Platform.

  • Service Providers may accept or reject requests at their discretion.

  • Prices, availability, and service details are set by Service Providers unless otherwise stated.

Once a booking is confirmed, both parties agree to honor the arrangement subject to these Terms.

6. Payments and Fees

  • Payments may be processed through third-party payment processors.

  • Fxify may charge service fees, platform fees, or commissions, which will be disclosed before confirmation.

  • Fxify is not responsible for payment failures caused by third-party providers.

All payments are subject to applicable taxes and local regulations.

7. Cancellations and Refunds

  • Cancellation policies may vary depending on the service and Service Provider.

  • Refund eligibility will be determined based on the applicable cancellation policy.

  • Fxify reserves the right to resolve refund disputes at its discretion but is not obligated to do so.

8. User Conduct

You agree not to:

  • Violate any applicable laws or regulations;

  • Use the Platform for fraudulent, abusive, or unlawful purposes;

  • Harass, threaten, or harm other users;

  • Circumvent the Platform to avoid fees;

  • Upload false, misleading, or infringing content.

We may suspend or terminate your access for violations.

9. Service Provider Obligations

Service Providers agree to:

  • Provide accurate information and credentials;

  • Perform services professionally and safely;

  • Comply with all applicable laws, licenses, and insurance requirements;

  • Be solely responsible for their tax obligations and compliance.

Service Providers are independent contractors and not employees of Fxify.

10. Ratings and Reviews

Users may leave ratings and reviews based on genuine experiences. Fxify reserves the right to remove reviews that are fraudulent, offensive, or violate these Terms.

11. Intellectual Property

All content on the Platform, including trademarks, logos, text, graphics, and software, is owned by or licensed to Fxify and protected by intellectual property laws. You may not copy, modify, distribute, or exploit any content without prior written permission.

12. Privacy

Your use of FxifyApp is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.

13. Disclaimers

FxifyApp is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding:

  • Service quality or outcomes;

  • Availability or reliability of the Platform;

  • Accuracy of information provided by users.

14. Limitation of Liability

To the maximum extent permitted by law, Fxify shall not be liable for:

  • Any indirect, incidental, or consequential damages;

  • Loss of profits, data, or reputation;

  • Injuries, damages, or disputes arising from services provided by Service Providers.

Our total liability, if any, shall not exceed the fees paid to Fxify for the specific service in question.

15. Indemnification

You agree to indemnify and hold harmless Fxify, its directors, officers, employees, and partners from any claims, damages, losses, or expenses arising out of:

  • Your use of the Platform;

  • Your violation of these Terms;

  • Your interaction with other users.

16. Suspension and Termination

Fxify may suspend or terminate your account at any time, with or without notice, if you violate these Terms or if required by law.

17. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform after changes means you accept the revised Terms.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Fxify operates, unless otherwise required by applicable law.
